    Il divieto di accesso ai luoghi dove si svolgono competizioni agonistiche, introdotto allo scopo di arginare l’ormai dilagante fenomeno della violenza negli stadi, si caratterizza per l’attitudine ad incidere sulla libertà personale del soggetto. Il provvedimento deve essere adottato sulla base di una ponderata valutazione delle circostanze sia oggettive che soggettive, quindi della concreta ed attuale pericolosità del soggetto che è anche il presupposto di giustificazione ed idoneità della misura stessa in relazione allo scopo che si intende perseguire. Di ciò l’Autorità competente deve dare atto nella motivazione del provvedimento che, per quanto espressione di un potere discrezionale, è sindacabile dall’A. G. sotto il profilo dell’eccesso di potere, nelle sue diverse forme sintomatiche, quali la manifesta illogicità, l’irragionevolezza, l’evidente sproporzione ed il travisamento dei fatti, ovvero la violazione del principio di adeguatezza, proporzionalità e del cd. gradualismo sanzionatorio.

    The prohibition of access to locations where sport competitions take place, introduced in order to curb the phenomenon of spreading violence in stadium, is characterized by the ability to affect the personal liberty of an individual. The decision must be adopted according to a meditated evaluation of both objective and subjective circumstances, that is the real and present dangerousness of the subject, which is also the condition of justification and appropriateness of the measure in terms of the objective to be pursued. The competent Authority must manifest these circumstances in the act that, as an expression of a discretion power, is questionable in terms of excess of power, in its different symptomatic forms, such as the apparent lack of logic, the unreasonableness, the obvious disproportion and misrepresentation of facts, or the violation of the principle of adequacy, proportionality and of the “graduality fine”.
