Resumen de La constitución de sindicatos con fines ilícitos y sus efectos jurídicos en el derecho del trabajo chileno

Puede suceder que en la constitución de un sindicato se respeten todas las formalidades legales, pero no exista ánimo colectivo, al no perseguirse con el mismo ninguno de los objetivos que le son propios, sino otros totalmente ajenos y, en ocasiones, además, dejar sin efecto actos jurídicos laborales válidamente ejecutados al amparo de normas jurídicas imperativas. Ante tal circunstancia, se analiza en el presente trabajo si estos sindicatos en nuestro derecho son lícitos, o por el contrario, ilícitos; debiendo para ello recurrirse a los principios jurídicos, por no existir regla legal expresa que solucione el problema. De concluirse que son ilícitos, es necesario determinar ante qué tipo de ilícito se está presente y la sanción que corresponde aplicar.

It may happen that in the constitution of a union all legal formalities are respected, but there is no collective will by it not pursuing any of the goals that belong to the union, but others totally unrelated, and that sometimes also leave without labor effect legal acts validly executed under imperative rules of law. In such circumstances, it is analyzed in this paper whether these unions are permissible under our law, or otherwise, unlawful, having for that to resort to legal principles, for there is lack of express statutory rule to solve the problem. If it is concluded that they are illegal, it is necessary to determine first what type of wrongful is present and the penalty to be applied.
