A raíz de las dos recientes SSTC 26/2005 y 30/ 2005, que han declarado la constitucionalidad del Impuesto de Depósitos de Entidades de Crédito (IDEC) estatal a tipo cero y la inconstitucionalidad del Impuesto autonómico homólogo de la Comunidad Valenciana, el autor reflexiona sobre la inconstitucionalidad de los diferentes IDEC autonómicos todavía vigentes. Este análisis de constitucionalidad no se aborda desde la perspectiva sustantiva por su incompatibilidad con el principio de capacidad económica, sino desde la perspectiva formal por yuxtaposición de dos figuras idénticas tributarias sobre el mismo hecho imponible. Desde este enfoque analítico se parte de la definición del bloque de constitucionalidad, y del papel singular que en el mismo juega la LOFCA, para estudiar el alcance del principio de preferencia de ley estatal ( art 6.2 LOFCA ) y su efecto de desplazamiento sobre los tributos propios autonómicos y realizar un estudio comparativo de los diferentes elementos que configuran los tributos incompatibles. Adicionalmente se analizan también las específicos motivos adicionales de inconstitucionalidad en que incurren el IDEC de Asturias y de Cataluña
Due to the Constitutional Court’s recent sentences 26/2005 and 30/2005, stating the constitutionality of Tax on Credit Entities' Deposits (“IDEC”) with a zero state tax rate, and the unconstitutionality of the Community of Valencia’s equivalent regional tax, the author reflects on the unconstitutionality of the regional IDECs still in force. Instead of taking a substantive approach, which is incompatible with the principle of economic capacity, he takes a formal approach by juxtaposing two tax identical figures on the same taxable event. This focus begins taking the definition of constitutionality block, and LOFCA’s unique role in it, to study the scope of the principle of Preference for State law (article 6.2. of the LOFCA) and its displacement effect on the autonomous regions’ own taxes, conducting a comparative study of the components that shape these incompatible taxes. There is also an analysis of the specific grounds for unconstitutionality attributable to the IDEC of Asturias and Catalonia
