El presente trabajo analiza la interpretación que merece una eventual lesión del derecho de huelga por quien no es empresario de los trabajadores huelguistas, al albur de la doctrina que contiene un pronunciamiento reciente del Tribunal Supremo, la STS de 11 de febrero de 2015, en una hipótesis cualificada también por la existencia de un grupo de empresa. Controversia que precisa para su adecuado tratamiento de una contextualización previa, tanto en relación con el derecho de huelga como respecto de los grupos de empresa, hasta derivar en su estado de regulación actual y su significación respectiva dentro del ámbito laboral.
This paper analyzes the legal interpretation of an eventual injury of the right to strike by whom is not the employer of the striking workers, according to the doctrine which contains a pronouncement of the Supreme Court, the judgment of 11February2015, in a qualified hypothesis also for the existence of a group of company. Controversy that requires proper treatment of a previous context, both in relation to the right to strike as well as a matter of company groups, to lead their state of current regulation and their respective significance within the workplace
