    La atribución del divorcio por mutuo consentimiento al notario, según la formulación del nuevo Código de Familia de Nicaragua supone para este retos.El divorcio, aun cuando sea por mutuo consentimiento, lleva consigo una ruptura o frustración del proyecto de vida, en tato que la familia es uno de los componentes esenciales en la vida de todo ser humano. El notariado en Nicaragua necesita nuevos horizontes, y la confianza que se le atribuye por el Estado en esta ocasión debe encararla con el decoro y la dignidad que caracterizan a la profesión. El reto está precisamente en saber encauzar con tino, proporcionalidad y sentido de lo justo, los principios de la función notarial en el ámbito del Derecho familiar.
