Algunas reglas sobre la investigación de la delincuencia organizada

    En el texto de la Ley Federal contra la Delincuencia Organizada, se incluyen disposiciones relativas a la investigación de la delincuencia organizada, tales como la infiltración de agentes, el arraigo, la reserva de la averiguación previa, la intervención de las comunicaciones privadas y la recompensa, entre otros. Sin embargo, aunque encubiertas en un marco de legalidad, estas medidas implican, muchas de las veces, vulneración de garantías y sanciones previas a una condena, ya que basta con indicios que hagan presumir que una persona es miembro de la delincuencia organizada, para solicitar y autorizar estos actos que afectan los derechos del individuo. Por más que esta reglamentación y la actuación, muchas veces arbitraria de la autoridad, pretendan responder a la gravedad de la delincuencia organizada y a la incapacidad para hacerle frente, la respuesta no debe buscarse en estos mecanismos autoritarios, sino en medidas preventivas y de concientización.

    In the Federal Law against the Organized Delinquency, dispositions relative to investigation of the organized delinquency are include, such as the infiltration of agents, the root, the reserve of the previous inquiry, the intervention of the private communications and it compensates it, among others. Nevertheless, although concealed in a legality frame, these measures they imply, many of the times, previous wounding of guarantees and sanctions to a sentence, since it is enough with indications that make be conceited that a person is member of the organized delinquency, to ask for and to authorize these acts that affect the rights of the individual. Such as more that this regulation and the performance, often arbitrary of the authority, try to respond to the gravity of the organized delinquency and to the incapacity to do to it in front, the answer doesn’t have to look for in these authoritarian mechanisms, but in preventive measures and of consciousness
