Se analizan una serie de Resoluciones del Tribunal Supremo relativas a la tasa general de operadores, anulándose sus liquidaciones porque no se justificó de ninguna forma el importe de sus cuantías.
Sobre las anulaciones y nulidades de liquidaciones tributarias, tanto por motivos formales, como materiales, el TS establece que los procedimientos anulados caducados y los nulos no producen interrupción de la prescripción, debiéndose computar esta desde la liquidación. Los procedimientos tributarios están sometidos a caducidad, por lo que, si se produjera, deben volver a iniciarse.
A series of Supreme Court Rulings related to the general operators’ tariff are analyzed, cancelling their liquidations because the sum of their amounts was not justified in any way.
Regarding tax liquidation cancellations and nullities, for both formal and material reasons, the Supreme Court establishes that the expired, cancelled and null proceedings do not interrupt the statute of limitations, and should be calculated from liquidation. Tax procedures are subject to expiry, so they should be restarted if this occurs
