La Ley de Propiedad Intelectual española —fechada en 1987 y cuyo Texto Refundido data de 1996, con diversas modificaciones posteriores— se ocupa, en diversos lugares, de las colecciones de obras intelectuales, derecho de colección del autor o de obras de otros, como también lo hacían la anterior Ley de Propiedad Intelectual de 1879 y su Reglamento, de 1880, aun en vigor hoy. En concreto el artículo 12 de la Ley establece que son objeto de propiedad intelectual las colecciones de obras ajenas, sin perjuicio en su caso, de los derechos que pudieran subsistir sobre las mismas a favor de sus autores o de los causahabientes, inter vivos o mortis causa, de aquellos. También, el artículo 33.2 LPI reserva al autor de conferencias, alocuciones, informes forenses o discursos pronunciados en sesiones parlamentarias o de corporaciones públicas, el derecho a publicar en colección tales obras. Este trabajo describe las implicaciones de este derecho de colección, partiendo de su consideración de derecho moral del autor con consecuencias económicas.

The Spanish Intellectual Property Act —published in the year 1987 and revised text which dates from 1996, with several subsequent amendments— deals with the so called «right of collection», the right of an author to make collections of his intellectual works, or collections of other’s works, as did also the previous Copyright Act of 1879 and its Regulation Act of 1880, still in force today. Specifically, Article 12 of the Act states that the collections of the works of others are an appropriate object of intellectual property, respecting the rights subsisting thereon in favor of the authors or acquirers of rights «inter vivos» or «mortis causa» of those. Also, the reservation made in article 33.2 LPI of the right of an author on lectures, forensic reports or speeches in parliamentary sessions or public corporations, the right to publish such works in collections. This paper describes the implications of this right of collection, based on its consideration of moral rights with economic consequences.
