A vueltas en la diferenciación entre el deportista amateur y el deportista profesional: Comentario a la Sentencia de la Sala de los Social del Tribunal Superior de Justicia de Cataluña, de 9 de mayo de 2014

    El análisis de la presente sentencia tiene por objeto el estudio del denominado "amauterismo compensado". La sentencia plantea la problemática que se suscita en el momento de difrenciar entre la prácica deportiva profesional, y la aficionada o amateur. La lectura de los distintos pronunciamientos judiciales ofrece un panorama casuístico en torno a la citada delomitación, así como una serie de criterios sentados por la, mal llamada, jurisprudencia menor cuyo objetivo es esclarecer los difusos contronos del deportista profesional y del deportista aficionado. Los criterios adoptados son: la irrelevancia de la calificación federativa, así como la otorgada por las partes; y la concurrencia o no de retribución en el deportista, ya que su inexistencia determinará que se está ante un deprotista amateur. El criterio de la retribución, como se observará en este comentario, ha de aplicarse a través de otros criterios orientadores establecidos por el Tribunal Supremo. En definitiva, la diferenciación entre deportista profesional y deportista aficionado es, en ocasiones, una tarea ardua.

    The analysis of the following sentence has the objective of studying the phenomen known as "compensated amateurism". The sentence sets out the problem which is brought out at the time of distinguish between doing sports professionally and doing sports as an amateur. The reading of the different judicial pronouncements, offers a casuistry outlook around the named delimitation, as a series of rules established by, the wrongly called minor jurisprudence, which aim is to clarify the vague limits of the athlete and amateur sporty. The rules adopted are: irrelevance of league table, as the one given by the parties, and the attendance of the athlete payment, since it absence will determine that he/she is an amateur sporty. The rule of payment, as it will be observe in this remark, has to be applied through other illustrative rules established by the Supreme Court. Summarizing, the differentiation between Athlete and amateur sporty is, sometime, an arduous work.
