    El Artículo 13.a) del Real Decreto 1006/1985 establece que, en caso de extinción por mutuo acuerdo del contrato de un deportista profesional que tuviese por objeto la cesión definitiva del deportista a otro club o entidad deportiva, el deportista tendrá derecho a una indemnización que no podrá ser inferior al 15% bruto de la cantidad estipulada, a falta de pacto entre las partes sobre condiciones económicas de conclusión del contrato. Mientras no existen dudas de que el obligado al pago de dicha indemnización es el club adquirente en el marco de un traspaso nacional, la situación no estaba tan clara hasta la fecha en el supuesto de un traspaso internacional. La sentencia objeto de análisis viene a aclarar y unificar los criterios dispares que sobre la materia habían mantenido los Tribunales Superiores de Justicia estableciendo que la responsabilidad del pago recae sobre el club cedente.

    Section 13.a) of Royal Decree 1006/1985 sets forth that, in case of termination by mutual agreement of the employment contract of a professional sportsman within the framework of the permanent transfer of said sportsman to another club or sports entity, the sportsman shall be entitled to a compensation which may not be lower than 15% of the gross amount established, in case no agreement exists between the parties about the economic conditions of the contract termination. Whereas there was no doubt about the fact that the acquiring entity is liable for the payment of said compensation in case of a national transfer, up to date the situation was not so clear in case of international transfer. The court decision at hand clarifies and unifies the various criteria applied by the Appellate Courts establishing that the selling club shall be responsible for the above-mentioned payment.
