Recientemente el Consejo Superior del Deporte ha presentado un modelo de acuerdo de incorporación del voluntario para entidades deportivas sin ánimo de lucro con objeto de aumentar la seguridad jurídica respecto a esta controvertida figura. En efecto, existen dudas de que los deportistas, entrenadores o técnicos deportivos puedan acogerse a la figura del voluntariado que tratarán de solventarse en este estudio. Sumado a ello, en el presente trabajo se pretende analizar la vinculación jurídica -ante la Inspección de Trabajo y los Tribunales- del acuerdo del voluntariado, asimismo, también se analizará la llamada "presunción de certeza" que puede contener el acuerdo firmado por las partes. En definitiva, se ambiciona conocer si la propuesta del Consejo Superior del Deporte va a ayudar en alguna medida a solucionar el conflicto planteado respecto a los miembros de los clubs sin ánimo de lucro.

Recently the Supreme Council for Sport has presented a model agreement for sports incorporation of voluntary nonprofit organizations to increase legal certainly regarding this controversial figure. Indeed, there are doubts that athletes, coaches and sports technicians eligible for the figure of the volunteer who will try to be solved in this study. Added to that, in the present work is to analyze the legal relationship -before the Labour Inspectorate and the courts- voluntary agreement also called "presumption of certainly" that can contain the agreement signed by the parties. In short, it aspires to know whether the proposal of the Superior Council of Sports will help somewhat to resolve the conflict raised regarding members of non-profit clubs.
