Resumen de Justicia restaurativa y mediación comunitaria: emergencia de un nuevo paradigma de impartición de justicia

  La Justicia Restaurativa es una respuesta sistémica al crimen que enfatiza la reparación del daño causado revelado por el comportamiento criminal.El nuevo paradigma llamado "Justicia Restaurativa" ha tenido impacto importante, es decir a significado ser la respuesta a muchas víctimas que pretenden una impartición de justicia pronta, justa y eficaz, además de poder sentirse escuchados y participar en el proceso que pretende la sanación. El término "Justicia Restaurativa" fue acuñado por primera vez en 1977 por Albert Eglash que distinguió tres tipos de justicia criminal: retributiva, distributiva y restaurativa. En este artículo nos proponemos analizar en un primero momento la emergencia de un nuevo paradigma, para después pasar al estudio del "state of the art" y, finalmente considerar la necesidad de su implementación en México.

  Restorative justice is a systemic response to crime that emphasizes repairing the harm caused by the criminal behavior . The new paradigm called "Restorative Justice" has had significant impact, ie meant to be the answer to many victims seeking a prompt impartation of justice , fair and efficient, In addition , the victims to feel heard and participate in the process aimed at healing.
