    With the advent of the Federal Constitution of 1988, was the democratization of state and society, so that participatory democracy has taken hold and allowed the emergence of tools for civil society participation in public decisions, especially in the formulation, control and execution of public policies, clearly demonstrating that democratization must cover state and society, thus ensuring and realizing rights. This article develops, so the Brazilian democratic opening theme and the consequent creation of boards of rights as instruments to realize rights, particularly in the present study, children and adolescents. Initially, there will be an analysis of the evolution of democracy and social participation in Brazil. Later, we will analyze some aspects concerning the rights of children and adolescents, approaching the rights guaranteed in the Constitution and the Statute of Children and Adolescents to, finally, to examine the Councils Rights of the Child and Adolescent and execution of fundamental rights. In this context, the research develops seeking to answer the following problems: the Advice of Rights of the Child and Adolescent are synonymous with realization of fundamental rights? To this end, we will use the method of hypothetical-deductive approach and method of procedure monograph, as well as the technical literature.

    Com a advento da Constituição Federal de 1988 ocorreu a democratização de Estado e Sociedade, de maneira que a  democracia participativa ganhou espaço e possibilitou o  surgimento de instrumentos de participação da sociedade nas  decisões públicas, principalmente na formulação, controle e  execução de políticas públicas, demonstrando claramente que a  democratização deve abranger Estado e sociedade, para assim,  garantir e concretizar direitos. O presente artigo desenvolve,  assim, o tema da abertura democrática brasileira e a  consequente criação dos conselhos de direitos como instrumentos para concretizar direitos, em especial no presente estudo, de crianças e adolescentes. Inicialmente, será feita uma análise sobre a evolução da democracia e da participação social no Brasil. Posteriormente, serão analisados alguns aspectos  acerca dos direitos das crianças e adolescentes, abordando-se direitos garantidos na Constituição Federal e no Estatuto da  Criança e do Adolescente para, ao final, analisar-se o Conselho  de Direito da Criança e do Adolescente e a efetivação de direitos fundamentais. Neste contexto, a pesquisa desenvolve-se  buscando responder à seguinte problemática: os Conselhos de  Direitos da Criança e do Adolescente são sinônimos de  efetivação de direitos fundamentais? Para tanto, será utilizado o método de abordagem hipotético-dedutivo e método de procedimento monográfico, bem como a técnica de pesquisa  bibliográfica.
