La previsión legal de atribución del uso la vivienda familiar al progenitor custodio e hijos menores del artículo 96 CC ha sido objeto de excepciones por el TS. Ni se atribuye en todo caso el uso de la vivienda que era familiar, admitiéndose otras viviendas alternativas, ni siempre tiene que efectuarse atribución expresa cuando las necesidades de vivienda del menor estén ya satisfechas por otros medios. En esta ocasión el TS admite la sustitución posterior de la atribución de la vivienda que había sido familiar (y privativa del padre) por otra distinta (propiedad de ambos progenitores), conciliando así el derecho de propiedad del padre con las necesidades de vivienda del hijo. La sentencia comentada repasa la doctrina jurisprudencial, admitiendo esta nueva excepción a la literalidad del artículo 96 CC
The legal provision for allocating the use of the family home to the custodial parent and the minor children in accordance with Section 96 of the Civil Code has been derogated by the Tribunal Supremo (Supreme Court). It does not attribute in all cases the use of the family home since it admits alternative housing, neither has always made a specific allocation when the housing needs of the child are already satisfied by other means. In this case, the Supreme Court supports the subsequent replacement of the allocation of the dwelling that had been familiar (and exclusive property of the father) with a different one (owned by both parents), thereby reconciling the ownership right of the father with the housing needs of the child. The annotated judgement reviews the case law doctrine, admitting this new exception to the literal wording of Section 96 of the Civil Code
