Resumen de Dogmática Jurídica

El presente trabajo tiene como objetivo analizar algunos de los significados más relevantes de la expresión “dogmática jurídica”. En primer lugar, se ofrece una definición de dogmática jurídica como sinónimo de ciencia jurídica. En segundo lugar, se examinan dos directivas metodológicas típicas del estilo dogmático: la (hipo-)tesis del legislador racional y la construcción de conceptos dogmáticos. Finalmente, se analizan diferentes tesis acerca de qué significa “aceptar dogmáticamente” el derecho.

This work analyzes some of the more important meanings of the expression “legal dogmatic”. First, it offers a definition of “legal dogmatic” as a synonymous of “legal science”. Second, it examines two methodological directives typical of dogmatic style: the (hipo-)thesis of the rational legislator and the construction of dogmatic concepts.
