En �La justicia y los derechos�, Ronald Dworkin presenta una teoría de justicia basada en un derecho que él considera como fundamental: el derecho que cada persona tiene a igualad de consideración y respeto en la administración y configuración de las instituciones políticas que rigen sobre ellas. Pero, ¿es este verdaderamente el derecho fundamental que tienen los seres humanos? No según Javier Hervada, quien, en �Lecciones propedéuticas de filosofía de Derecho� postula que el derecho fundamental que tiene las personas es el derecho a ser, el cual incluye dos elementos básicos: la libertad y el dinamismo.
Es necesario examinar ambas teorías para evaluar lo que tiene en común y los puntos en los cuales difieren para así, poder concluir sobre cuál de los derechos es verdaderamente fundamental y si la igualdad juega un papel en él.

In �Justice and Rights� Ronald Dworkin presents a theory of justice based in a right which he considers to be fundamental: the right every person has to be considered and respected in equal measure in the administration and configuration of the political institutions that rule over them. But, is this truly the fundamental right human beings have? Not according to Javier Hervada, who, in �Propaedeutic lessons in Philosophy of Law� postulates that the fundamental right people have is the right to be, which includes two basic elements: freedom and dynamism.
It is necessary to examine both theories in order to evaluate what they have in common and the points in which they differ, so that we can come to a conclusion about which of the rights is truly fundamental and whether or not equality plays a role in it.
