    n an address to the Society of Comparative Legislation, the author attempts to outline the history and evolution of moral damages in French law. In the awarding of moral damages France might be called the first liberal regime in Europe. The « awakening » and flowering of this novel idea took place in the nineteenth century. The evolution was quite singular, for it was in part inspired by the practice of the Parliaments of the Old Regime, though its modern development derives from an introspective interpretation of the Code Civil. The notable achievement at the end of the day is to place material and moral damages on aplane of equality, both in the area of delictual responsibility and contractual responsibility.

    Dans un discours devatlt la Société de Législation Comparée l'auteur essaie d'exposer l'histoire et l'évolution du dommage moral en droit français. Quant a la réparation des dommages moraux, la France fut le premier régime libéral en Europe. Ce développement a pris son « éveil » et achevé son essor au dix-neuvieme siecle.

    L'évolution est assez singuliere, inspirée en partie par la pratique des Parlements de l'ancien régime, bien que son développement modeme dérive d'une interprétation introspective du Code civil. La principale réalisation de la France est de placer les préjudices matériels et moraux sur un plan d'égalité, tant en matiere de responsabilité délictuelle que de responsabilité contractuelle.
