Resumen de Direito e Diferença: considerações constitucionais sobre o direito e a identidade

  This article focuses initially on the way of comprehending the consolidation of subjectivity, and therefore of an identity, through the philosophy that gives emphasis to recognition, to the detriment of social contract theory. Then it discusses the dichotomy between liberal and social rights and their possible influence on the shaping of cultural rights, in the bonds related to people’s own identity. It claims that cultural production should be democratized, including the host of distinct cultural manifestations, without the sole concentration of cultural signs and their values in government hands. It also proposes people’s right to an identity of their own as a criterion for assessing the social right to culture, with the understanding that the differences should be protected as long as they are required to constitute the defense of fundamental rights.Key words: fundamental rights, identity, difference.

  O presente artigo versa, inicialmente, sobre a forma de compreensão da consolidação da subjetividade e, por consequência, de uma identidade, através da filosofia que confere ênfase ao reconhecimento, em detrimento da teoria do contrato social. Em seguida, discute a dicotomia entre os direitos liberais e sociais e sua possível influência na configuração do direito à cultura, nos liames pertinentes a uma identidade própria. Expõe que a produção cultural deve ser democratizada, com o acolhimento das distintas manifestações culturais, sem a concentração exclusiva dos signos culturais e seus valores nas mãos do governo. Propõe, ainda, o direito a uma identidade própria, como critério para a avaliação do direito social à cultura, com o entendimento de que as diferenças devem ser protegidas na proporção em que são demandadas para constituir a defesa de direitos fundamentais.Palavras-chave: direitos fundamentais, identidade, diferença.
