Resumen de Impasses e alternativas em 200 anos de constitucionalismo latino-americano

  The paper aims to comparatively analyze the limits and solutions found by Latin American constitutionalism in its 200 years of existence. In this scenario, it must be highlighted the social and political changes both in the course of the 19th century as the end of the last century. Considering Roberto Gargarella’s ideas, we primarily wonder if today’s redefinition of the state and its offshoots are able to break both with the mark of inequality as well as with an elitist meaning of democracy, features that are historically envisioned here. Based on this, we also discuss the contextualization of the current moment of Latin American constitutionalism, to which we give the adjective new due to the explanatory perspective presented by Roberto Viciano and Rubén Dalmau. Then, the study addresses, in accordance with the view of Raquel Yrigoyen, the pluralist constitutionalism in its main aspects, highlighting the self-determination of indigenous peoples. Finally, we conclude with Boaventura de Sousa Santos’s proposal, which postulates the refounding of the State, contrasting with a breaking view.Key words: Latin American constitutionalism, State, pluralism.

  O trabalho objetiva analisar comparativamente os limites e as saídas encontradas pelo constitucionalismo latino-americano em seus 200 anos de existência. Nesse cenário, merecem destaque as mudanças sociais e políticas ocorridas tanto no decorrer do século XIX, como no final do século passado. Trazendo à baila o pensamento de Roberto Gargarella, questiona-se primariamente se a hodierna redefinição do Estado e seus desdobramentos representam instrumentos aptos para romper tanto com a marca da desigualdade, quanto com uma concepção elitista de democracia, características historicamente vislumbradas por aqui. A partir disso, o paper abre espaço também para uma contextualização do atual momento do constitucionalismo latinoamericano, onde a ele aplica-se o adjetivo Novo, em razão da perspectiva explicativa apresentada por Roberto Viciano e Rubén Dalmau. Dando continuidade, o estudo aborda ainda, consoante o olhar de Raquel Yrigoyen, o constitucionalismo pluralista em suas principais vertentes, realçando-se a autodeterminação dos povos indígenas. E, por fim, arremata com a proposta de Boaventura de Sousa Santos, que postula pela refundação do Estado, em frontal contraposição a uma visão de quebra.Palavras-chave: constitucionalismo latino-americano, Estado, pluralismo.
