Alegaciones jurídicas del siglo XVII en Cataluña: la obra de Josep Ramon

    En la Cataluña del siglo XVII tiene un especial interés el análisis de los memoriales, posteriormente conocidos como alegaciones en derecho. En su gran mayoría son documentos vinculados a la praxis forense (aunque algunas veces también se utilizaban en controversias de tipo político), que gracias a la impren- ta adquieren una difusión extraordinaria en el mundo jurídico, y que ha permiti- do su conservación e incipiente estudio.

    Las alegaciones requerían que su redactor tuviera un buen conocimiento y dominio de la legislación aplicable al caso concreto. Una buena alegación se caracterizaba porque su autor exponía con detalle no sólo su erudición jurídica en lo que refiere al conocimiento y manejo de las fuentes (legislativas, judicia- les, doctrinales, etc.), sino también sus recursos profesionales para aplicarlos al caso concreto.

    Las alegaciones o su equivalente «porcones» en Castilla son muy diversas en cuanto al formato, realizadas en el marco de un juicio contradictorio y con el objeto de convencer a los magistrados sobre la bondad y rectitud de los argu- mentos de una de las partes litigantes . En Cataluña, además, adquiere un espe- cial interés el tema puesto que las sentencias judiciales debían motivarse, lo que transformaba las alegaciones en un instrumento que de los argumentos de cada parte para convencer al juez y ayudarle en la localización del argumento y nor- ma jurídica más adecuada y justa para la resolución del caso. Como ejemplo, se analiza la obra que Josep Ramon publicó en Barcelona en 1628: un primer volu- men de consilia (Josepho RAMONIO, Consiliorum una cum Sententiis et Deci- sionibus Audientiae Regiae Principatus Cathalonia.) La obra incorpora los res-ponsa iuris más significativos del autor, aunque parece ser estaban seleccionados en función del prestigio de los clientes de cada caso o litigio

    In the Catalonia of the 17th century has a special interest the analysis of allegations in right. In his great majority they are documents linked to the foren- sic practice (though often also there were in use in controversies of political type), that thanks to the press acquire an extraordinary diffusion in the juridical world, and that it has allowed his conservation and incipient study. The allega- tions need that his editor had a good knowledge and domain of the legislation applicable to the concrete case. A good allegation was characterized because his author was exposing closely not only his juridical erudition in what it recounts to the knowledge and managing of the sources (legislative, judicial, doctrinal, etc.), but also his professional resources to apply them to the concrete case. The allegations or his equivalent «porcones» in Castile are very diverse as for the for- mat, realized in the frame of a contradictory judgment and in order litigators convince to the justices on the kindness and honor of the arguments in one in the parts. In Catalonia, in addition, he acquires a special interest the topic since the judicial judgments had to be motivated, which was transforming the allegations into an instrument that of the arguments of every part to convince the judge and to help to find the argument and the most suitable juridical and just norm for the resolution of the case. As example, we analyze the work that Josep Ramon published in Barcelona in 1628, the first volume of consilia (Josepho RAMONIO, Consiliorum a cum Sententiis et Decisionibus Audientiae Regiae Principatus Cathalonia.) The work incorporates the most significant responsa iuris of the author, though it seems to be they were selected depending on the prestige of the clients of every case or litigation.
