Resumen de El nuevo mapa marítimo de Portugal y el caso de las Islas Salvajes

  En este artículo se aborda la actual política marítima portuguesa, en especial el proceso de «expansión» de la plataforma continental emprendido por Portugal ante la ONU y su resultado: �el nuevo mapa marítimo de Portugal�. Sin embargo, algunas de las fronteras propuestas en este nuevo mapa no fueron todavía acordadas bilateralmente con España. Esta situación ha originado ciertas tensiones diplomáticas entre los dos países, que son objecto de análisis en este trabajo. No obstante, en el mismo defendemos que es posible superar estas diferencias si apostamos en las potencialidades del «nuevo Derecho del Mar». Denominamos así a la articulación de la Convención de la ONU sobre Derecho del Mar (CNUDM) con el Derecho Comunitario sobre la materia �especialmente, la Directiva Marco de Estrategia Marina (DMEM). Una de las principales conclusiones de este artículo es que la Directiva, necesariamente, contribuirá para el refuerzo de la cooperación hispano-lusa en materia de protección del medio marino, pero no sólo, también en las cuestiones relacionadas con el establecimiento de las fronteras marítimas.

  This paper makes a brief review about the current Portuguese maritime policy, especially, the «expansion» process of the continental shelf undertaken by Portugal to the UN and its result: �the new maritime map of Portugal�. However, some of the borders in this new map were not yet agreed bilaterally with Spain. This situation has led to diplomatic tensions between the two countries, which are object of this paper analise. However, we argue that it is possible to overcome these disputes if we focus on the potential of the �new Law of the Sea�. So call, the articulation of the United Nations Convention on Law of the Sea (UNCLOS) with the European Law existing on this subject �especially the Marine Strategy Framework Directive (MSFD). One of the main conclusions of our paper is that this directive will contribute to the strengthening of the Portuguese-Spanish cooperation on protection of the marine environment, as well as to resolve issues related to the establishment of maritime boundaries.
