Resumen de Acerca de la fuerza de los enunciados probatorios: el salto constitutivo

Este ensayo propone una crítica a la tesis pragmática según la cual los enunciados probatorios de las decisiones judiciales del tipo «está probado que p» poseen fuerza descriptiva siendo, por tanto, verdaderos o falsos. En primer lugar, se dilucida la noción de fuerza pragmática y se estipula la distinción entre enunciados descriptivos y normativos. Luego, se muestra que en los contextos procedimentales donde el sistema de valoración de la prueba es el conocido como Sana Crítica Racional, los enunciados probatorios, por una parte, expresan un juicio valorativo de quien los profiere y, por la otra, fungen de razones prácticas dirigidas a justificar una acción del mismo emisor, a saber: la aceptación del enunciado fáctico como premisa de la decisión judicial. Estas circunstancias, se sostiene, muestran que enunciados probatorios proferidos en esos contextos poseen fuerza normativa postulándose provisoriamente su carácter constitutivo.

This essay proposes a criticism to the pragmatic thesis according to which, the proof statements of judicial decision of the kind «it is proven that p» have descriptive strength, being, therefore, true or false. First of all, the notion of pragmatic strength is enlightened and the distinction between descriptive statements and normative statements is provided. Then, it is shown that in judicial process contexts where the proof evaluation system is the well-known as principle of «free proof», the proof statements, in one hand express a judgment of value of the one that utters them, and in the other hand, they work as practical reasons aiming to justify an action of the decision-maker by himself, namely: the acceptation of the factual statement as a premise of the judicial decision. This circumstances, it is upheld, demonstrate that proof statements issued in this kind of contexts bear a normative strength, postulating temporarily their constitutive character.
