Resumen de Controversias jurídicas en torno a los impedimentos romanos y la intersexualidad.

De forma similar a como hoy se regulan los impedimentos matrimoniales en nuestro Ordenamiento jurídico español, El Derecho Romano trató de sistematizar las numerosas uniones que no cumplían con los requisitos exigidos para conformar un matrimonio clásico legítimo o iustum matrimonium. En este sentido, con la realización del presente trabajo pretendemos investigar cuáles son las dificultades de las fuentes para definir etimológicamente el término impedimentum, y cómo dichas limitaciones evolucionaron en las leyes promulgadas por Augusto y Constantino, prestando especial atención a los impedimentos y promesas de futuro matrimonio o esponsales romanos. Lo que nos servirá, en todo caso, para ofrecer una clasificación que integre esas restricciones y así comprender la razón de ser de las uniones extramatrimoniales sine conubio o la ilicitud de las relaciones esporádicas; destacando, finalmente, el controvertido supuesto de la intersexualidad en época de crisis generalizada como la que estamos viviendo actualmente en España.

In a similar way as the matrimonial impediments are regulated nowadays in our Spanish legal System, Roman Law tried to systematize the numerous marriages that did not have the conditions required to form a legitimate classic marriage or iustum matrimonium. In this sense, with the accomplishment of the writing that follow we pretend to investigate what are the difficulties of the sources to defines etymologically the term impedimentum, and how these limits evolved in the laws promulgated by Augustus and Constantine, paying special attention to the case of the impediments to the promises of future marriage or roman betrothal. The above will serve us, in any case, to provide a classification of these marriage restriction and we understand the reason for the extramarital unions sine conubio and the possible illegality of such casual encounters; highlighting, finally, the controversial case of intersexuality in time of generalized crisis such as we living in Spain.
