Primera cuestión prejudicial del Tribunal Constitucional francés al Tribunal de Justicia de la Unión Europea.

    En una decisión de la QPC del 4 de abril de 2013, el Tribunal constitucional francés -el Conseil constitucionnel- planteó su primera cuestión prejudicial al juez europeo relativa a la interpretación de la decisión-marco que estableció la orden de detención europea. Esta cuestión prejudicial "extraordinaria" se puede explicar en realidad por distintos motivos. Primero, el contexto general del acercamiento constitucional francés en el ordenamiento europeo que permitió al juez constitucional cruzar por fin este Rubicon jurídico. Segundo, la voluntad de acabar con el proceso de su "jurisdiccionalización" gracias a este diálogo inter-jurisdiccional. El presente estudio vuelve sobre esta importante decisión QPC, analizando tanto los fundamentos jurídicos desarrollados por el Conseil como las consecuencias principales que se desprenden de esta primera cuestión prejudicial.

    In a QPC ruling dated from 4° April 2013, the French constitutional court - the Con-/ seihynistittilionnel - made its very first preliminary reference to the European Court of Justice /reoarding the interpretation of one of the dispositions of the Framework Decision establishing the European Arrest Warrant. Actually, several reasons can explain this "extraordinary" decision. First of all, the general context of a certain alignment of the French constitutional system with I the European legal order that gave the opportunity to the constitutional court to finally cross that legal Rubicon. Secondly, the will for the Conseil to end the process of its "jurisdictionalization" through this inter-jurisdictional dialogue. The present article revisits this important QPC ruling and tries to stress not only its legal grounds but also the main consequences of such a decision.
