The decision of the Danish Supreme Court in the "start-up assistance" case helps to clarify several questions about Article 75(2) that have been discussed in the constitutional law literature. In the judgment, it is established, first, that the courts may review whether the legislative branch has met the requirements that follow from the provision. Second, the judgment cements the fact that Article 75(2) - alone - obligates the legislative branch to ensure citizens a right to basic relief assistance. Third, it establishes that the provision does not only cover Danish citizens but - at least - also foreigners who reside legally in Denmark.

L'arrêt de la Cour suprême danoise dans l'affaire "start-up assistance" aide à clarifier certains points concernant l'article 75, paragraphe 2, qui ont été discutés dans la littérature du droit constitutionnel. L'arrêt établit, premièrement, que les tribunaux peuvent examiner si le pouvoir législatif a satisfait aux exigences qui découlent de la disposition. Deuxièmement, l'arrêt confirme le fait que cet article 75, paragraphe 2 - à lui seul - oblige le pouvoir législatif à garantir aux citoyens un droit à une assistance de base. Troisièmement, il établit que la disposition ne couvre pas seulement les citoyens danois, mais aussi - à tout le moins - les étrangers qui résident légalement au Danemark.
