El propósito del artículo es proponer una ruta para comprender los fenómenos constituyentes y específicamente, el acto constituyente Colombiano de 1991. Para ello, explicará los aportes que podría ofrecer el enfoque analítico como actitud filosófica y el realismo jurídico tributario de dicha corriente en la comprensión de los “hechos jurídicos” constituyentes. En este camino, se resaltarán algunas explicaciones tradicionales del poder constituyente y luego se realizará un análisis desde las sugerencias analíticas. Finalmente, se abordará el fenómeno constituyente colombiano, tratando de resaltar la importancia de determinar la influencia de los grupos de poder en la construcción y eficacia de las normas constitucionales.

The purpose of the article is to propose a way to understand the constituent phenomena and specifically, the Colombian constituent act of 1991. To do this, will be explained the contributions that could provide the analytical approach as philosophical attitude and the juridic realism of the tax law of the mentioned current in the understanding of the “constituent legal facts”. In this way, will be highlighted some traditional explanations of the constituent power and then it will do an analysis from the analytical suggestions. Finally, it will approach to the Colombian constituent phenomenon, trying to highlight the importance of determining the influence of the powerful groups in the construction and effectiveness of constitutional norms.
