  • Resumen
    • This article explores the ways in which the enjoyment of cultural human rights is developing nowadays. The content of these rights needs to be clarified in order to render the existence of consistent and durable cultural policies possible. Both General comment No. 21 on “the Right of everyone to take part in cultural life” (United Nations Committee on Economic, Social and Cultural Rights, 2009) and the appointment of the first Independent Expert on cultural rights (Council of Human Rights, 2009) offer tools for determining the content of the right of access to culture as an independent right. The author takes into account the guidelines put forward by the Committee on Economic, Social and Cultural Rights in May 2012 regarding the measures adopted by States in the context of the economic and financial crisis and the effects of these on European cultural policies.
