This paper aims at analyzing basic aspects from the new Spanish arbitration law (60/2003 Law), that established new juridical system about the institute, proposing real incentives to individuals and enterprises so that they could choose this way of solving conflicts. The law adopted the monist paradigm and through it, the internal judgment as well as the external one (international) have almost the same regulation, since principles would be few, but very justified where international arbitration requires a distinct regulation from the national one.
O artigo analisa aspectos fundamentais da nova lei de arbitragem espanhola (Lei 60/2003), que estabeleceu novo regime jurídico sobre o instituto, com a finalidade de oferecer incentivos reais às pessoas físicas e jurídicas para que optem por esta via de resolução de conflitos. A lei adotou o paradigma monista, pelo qual tanto a arbitragem interna quanto a externa (internacional) possuem praticamente a mesma regulamentação, visto que seriam poucas e muito justificadas as normas em que a arbitragem internacional requer uma regulação distinta da arbitragem nacional.
