El artículo 186 bis del Código Penal por el que se tipifica el tráfico de órganos humanos plantea diversos problemas, especialmente, en relación con la determinación del interés que se pretende proteger y la interpretación de las conductas típicas. Pero, además, se abordan, por un lado, las principales diferencias entre la regulación española del tráfico de órganos humanos y la prevista en otros ordenamientos jurídicos; y, por otro lado, los rasgos que permiten distinguir este delito de la figura legal de la trata de personas con fines de extracción de órganos (art.177 bis.1.c CP).

The article 156 bis of the Penal Code, punishing the trafficking in human organs, raises several problems especially those related with the determination of the interest called to be protected as well as the interpretation of the criminal behavior themselves. The study of these two problems constitutes the main objective of this paper. Furthermore, it deals with the most important differences between the Spanish' regulation against trafficking in human organs as compared to similar regulations in other legal systems on the one hand and, on the other hand, it investigates whether this crime is distinguishable from the human trafficking with the purpose of the removal of organs (art. 177 bis.1.c PC).
