    • This paper highlights tha concept of the "unjust law" and, consequently, that of "just disobedience" to such a law, as it is in early Franciscan legislation, which predates that of modern States, just as it predates the international law of human rights and the present canon law of the whole Church. Following a brief reflection on obedience and unjust laws in terms of the Code of Canon Law, the discourse is dedicated to the Regula Non Bullata (1221), to the Regula Bullata (1223) and to Admonition III. In all three texts there is found an emphasis on the importance to religious life of obedience, both as a virtue and as a way of life, and equally on the need to discern when it is not possible to obey because a command is contraty to the Gospel and to the Rule. At the centre of St. Francis's thought is the human being in the fullness of his capacity for thought and action, which is not annihilated by obedience.
