La iniciativa legislativa en el Derecho Civil de Galicia

    La forma de ejercicio por la Comunidad Autónoma de Galicia de sus competencias en materia de conservación, modificación y desarrollo del derecho civil propio no ha estado exenta de una cierta polémica en los sectores jurídicos gallegos. Sin embargo la vigente Ley 2/2006, de 14 de junio, al igual que ya sucediera con la anterior Ley 4/1995, de 24 de mayo, es el resultado de una ponencia conjunta presentada por todos los grupos parlamentarios y aprobada por unanimidad por el Parlamento de Galicia. Ello no ha evitado la existencia de problemas técnicos (recursos y cuestiones de inconstitucionalidad) y de críticas al texto legal vigente, especialmente en aspectos de engarce con el derecho histórico. Con todo, cabe decir que las iniciativas legislativas se han realizado teniendo en cuenta la colaboración y aportación de los operadores jurídicos gallegos.

    The manner in which the competencies of the Autonomous Com munity of Galicia are exercised in matters regarding the preservation, amendment and implementation of its inherent civil law has not been without its fair share of controversy in Galician legal sectors. However, the current Law 2/2006, of 14 June, similar to what occurred with the former Law 4/1995, of 24 May, is the result of a joint paper presented by all parliamentary groups and approved unanimously by the Galician Parliament. This has not prevented the existence of technical problems (resources and non-constitutional issues) and criticism of the current legal text, in particular those aspects which latch onto historical law. Nevertheless, it must be mentioned that all legislative initiatives have been made taking into account the cooperation and contribution of all Galician legal players.

    Galiziako Autonomia Erkidegoak bere zuzenbide zibilari buruzko ahal menak sustatu, eraldatu eta garatzeko moduak gatazkatsu izan dira kasu batzuetan mundu juridiko galiziarrean. Hala ere, egun indarrean dagoen eekainaren 14ko 2/2006 Legea, aurretiazko maiatzaren 24ko 4/1995 Legearen antzera, Galizia ko Parlamentuan talde parlamentario guztiek aurkeztu zuten ponentzia baten emaitza da. Hori aho batez onetsi zen. Horrek ez ditu baztertu arazo teknikoak (he legiteak eta konstituzioaren aurkako gaiak) eta testuarekiko kritikak, batez ere, zu zenbide historikoarekin izan dezakeen loturari buruz. Dena den, ekimen legegileak beti egin izan dira aintzat harturik galiziar eragile juridikoen ekarpenak.
