Resumen de El derecho social de la Unión Europea. Refl exiones a propósito del sistema de fuentes

  En el presente artículo se hace un exhaustivo estudio del Derecho social de la Unión Europea desde la perspectiva del sistema de fuentes. Partiendo de la evolución histórica del sistema normativo de la Unión en materia social se analizan las competencias más importantes que actualmente asume la Unión Europea en dicha materia y los concretos procedimientos de producción del Derecho social Europeo que van desde la armonización al más reciente método abierto de coordinación. A partir de tal premisa se hace un repaso de todos los posibles actos normativos, tanto del Derecho primario como del derivado, clasifi cándolos en aquellos que constituyen instrumentos jurídicos obligatorios (tales como el Reglamento, la Directiva y las Decisiones) y aquellos otros que no revisten tal carácter (Recomendaciones; Dictámenes o Informes, Declaraciones y Resoluciones); sin olvidar el papel «complementario» del Tribunal de Justicia de la Unión Europea y las nuevas posibilidades que se abren al diálogo social europeo

  In the present article there is done an exhaustive study of the European Social Law from the perspective of the system of sources.

  Departing from the historical evolution of the normative system of the Union in social matter the issues more important are analyzed that nowadays the European Union assumes in the above mentioned matter and the concrete procedures of production of European Social Law that go from the harmonization to the most recent open method of coordination. From such a premise there is done a revision of all the possible normative acts, classifying them under those that constitute juridical obligatory instruments and different those that do not re-dress such a character; without forgetting the «complementary» paper of the Court of Justice of the European Union and the new possibilities that are opened for the social European dialog.
