    Con ocasión de la primera sentencia sobre discriminación arbitraria en nuestro país, el autor sugiere la existencia de una nueva área dentro de nuestro derecho, el derecho antidiscriminación chileno; identifica los principios que lo estructuran; subraya el trasfondo homofóbico del caso en cuestión; revisa acontecimientos dentro del juicio por discriminación comentado a fin de sugerir problemáticas futuras que seguirán surgiendo en la tramitación de este tipo de acciones;y concluye delineando algunas modificaciones necesarias a la Ley Antidiscriminación. Se pone especial énfasis en el rol sociocultural transformador que ha de darse a la Ley por parte de los operadores jurídicos

    In the wake of the first decision on unfair discrimination in our country, the author suggests the existence of a new area within our legal system, i.e. Chilean antidiscrimination law; identifies the principles that structure it; underscores the homophobic background of the case at issue; reviews events within the trial under consideration in order to suggest future questions that will continue to emerge in this kind of lawsuits; and concludes by sketching some amendments that should be introduced to the Antidiscrimination Statute. It is given a special emphasis to the sociocultural transformative role that juridical agents must give to the Statute
