En este texto se reflexiona sobre el contexto, los hechos y los argumentos de los partes de la reforma del Reglamento de las Cortes de Castilla la Mancha respecto de las retribuciones de los diputados. A pesar de que la sentencia del Tribunal Constitucional (STC 36/2014, de 25 de febrero) desestima la tacha de inconstitucionalidad de la reforma, el autor entiende que la motivación de la misma no resulte plenamente suasoria, en particular, en lo que afecta al carácter sobrevenido de una medida reglamentaria que se aplica a los parlamentarios retroactivamente, en mitad de la Legislatura, sin modificarse al tiempo el régimen de incompatibilidades, lo que parece generar una desproporcionada alteración de las condiciones de acceso al cargo ex post facto y desprovista de suficiente justificación.
This text analyses the context and debate of the reform of the regulation of the regional parliament of Castilla la Mancha regarding the salaries of MPs. Although the Spanish Constitutional Court (STC 36/2014, of 25 February) backed the reform, the author argues that the motivations of the reform are not convincing, particular since the new regulation will be applied retroactively to the MPs in the middle of the Legislature. At the same time the regulation of incompatibilities will remain unchanged, which seems to provoke a disproportionate alteration of the conditions of access ex post facto with insufficient justification.
