Resumen de La convivencia escolar y su reflejo en el Derecho. Propuestas jurídicas para mejorar el clima en las aulas y la calidad de la enseñanza

  Este artículo aborda los diferentes aspectos en que la convivencia escolar y el Derecho aparecen relacionados. Se fija en la definición que ofrecen las normas jurídicas a la violencia en las aulas y al acoso escolar. Expone las consecuencias que tiene sobre los miembros de la comunidad educativa, así como la responsabilidad civil de los padres y de los centros. Identifica también la relación que existe entre el clima de clase y la calidad educativa. Esto permite analizar las distintas políticas educativas que han desarrollado las administraciones educativas –principalmente las autonómicas‒ con el fin de mejorar la convivencia escolar y la calidad de la enseñanza. Se centra principalmente en las recientes leyes de autoridad del profesorado, y en la necesidad de que las familias se esfuercen por educar debidamente a sus hijos y colaboren con los centros y profesores.

  This article argues the main features of the peaceful coexistence in the schools and its relationship to the Law. It pays attention to the definition of violence and bullying which is given by the rules. This work exposes their consequences for the members of the school, as well as the civil responsibility of parents and schools. It also identifies the relationship between the classroom atmosphere and the education quality. It let us examine the educational politics developed by the Public Administrations –mainly the Spanish Autonomous Communities or Regions– in order to get a better coexistence in the schools and the education quality. It focuses on the recent rules about teachers’ authority, and on the need of the families making an effort to give a good education to their children, and their cooperation with schools and teachers.
