A Constitución de 1978 como parte da Transición Española cara á democracia e influenciada doutros textos constitucionais europeos, é a primeira que se alcanza en España por consenso, e que acertou a implantar o principio democrático como único principio político lexitimador, erguéndose como cabeza e fundamento de todo o ordenamento xurídico, cuxos preceptos gozan de valor normativo e punto de referencia inescusable na interpretación de todas as normas.
1978 Constitution was the result of the transition process, a political movement which allowed Spain to change from a dicatorial regym to a democratic system. This Constitution, which followed some of the European Constitucional tendences, was the first in all the Spanish history to be consensuated, and to implant the democratic principle as the only politically legitime. This Constitution is the fundament of all our legal framework, and its precepts have to be respected when laws are interpreted.
