Resumen de El órgano de investigaciones criminalísticas en el contexto de las campañas securitarias

¿Las lógicas securitarias deben guiar las reformas legislativas que afectan al órgano de investigaciones criminalísticas? ¿Éstas deben afectar también la dirección que ejerce el Ministerio Público sobre la investigación penal? ¿El órgano de investigaciones debe ser considerado como una policía más? O, por el contrario, ¿tiene características propias que le diferencian de la institución policial? ¿La investigación penal debe ser entendida como parte del servicio de policía o como una fase del proceso penal? Del enfoque de las respuestas a estas interrogantes y de la precisión conceptual de los distintos términos empleados en estas áreas dependen importantes decisiones políticas, que pueden contribuir a la construcción del Estado Social de Derecho y de Justicia consagrado en la Constitución, o por el contrario, pueden coadyuvar también al fortalecimiento del Estado de Policía que subyace latente en todos los Estados de Derecho. En este trabajo se intentan hacer estas reflexiones desde el contexto venezolano, analizando críticamente la reciente legislación que ha introducido modificaciones en estas materias.

Should securitarian logic guide legislative reforms that affect the body for criminalist investigations? Should it also affect the leadership that the Public Ministry exercises over criminal investigation? Should the body for investigations be considered as just another police force? Or, on the contrary, does it have its o wn characteristics that distinguish it from the police institution? Should penal investigation be understood as part of the police service or as a phase in the penal process? Important political decisions depend on the approach adopted to respond to these questions and the conceptual precision of the different terms used in these areas, which can contribute to constructing the Social State of Law and Justice consecrated in the Constitution; or on the other hand, it can also help to strengthen the Police State that underlies all States of Law in a latent manner. In this work, some reflections are attempted from the Venezuelan context, analyzing critically the recent legislation that has introduced modifications in these matters
