El activismo judicial, una herramienta de protección constitucional

      En el presente trabajo el autor examina el rol del juez en el siglo xxi, donde los titulares del Poder Judicial dejaron de ser meros espectadores para transformarse en protagonistas irremplazables del proceso judicial. Esta corriente doctrinaria se denomina “activismo judicial”, que surge y se desarrolla a través de parámetros constitucionales. Para una mejor comprensión de la temática, se efectúa un análisis su génesis de su correcta evolución hasta llegar a su actual composición. No todo activismo es bueno y no todo activismo es malo. Para poder lograr un equilibrio se han desarrollado las diferentes clases o tipos de activismo judicial, como ser: Activismo razonable o justo y activismo irrazonable o injusto. Tanto la jurisprudencia como la doctrina, cumplen un papel primordial en el terreno de la exhaustividad y completitud de la mentada temática; donde deriva el orden publico constitucional y los nuevos institutos que conforman el activismo judicial constitucional, como ser: la inconstitucionalidad por omisión y de oficio, y las garantías constitucionales. Finalmente pondera la especial incidencia o utilidad del activismo judicial para un mejoramiento del proceso judicial y para el cumplimiento de las exigencias constitucionales, utilizando sus propias herramientas para el logro dichos objetivos.

      In this research, the author examines the role of the judge in the Twenty-first century, where the former recipient of the Judiciary ceased to be mere spectators to become irreplaceable protagonists of the judicial process. This present doctrine is called “Judicial activism” that emerges and develops through constitutional parameters. For a better understanding of the subject, there is an analysis of the correct genesis evolution into its existing composition. Activism is neither all good nor all bad. In order to reach a balance there has been developed different classes or types of judicial activism such as: Fair activism, reasonable, unreasonable or even unfair. Both case law and doctrine, have played a essential role in the field of completeness and wholeness of the stated subject; where constitutional public order derives from and new institutions that make up the constitutional judicial activism, such as: the inconstitutionality by omission and by request the judge without request of either party, and constitutional guarantees. It finally considers the special impact or usefulness of judicial activism to improve the judicial process and to fulfill the constitutional requirements, using their own tools in order to achieve those objectives
