Resumen de La argumentación judicial: control y responsabilidad de los órganos jurisdiccionales

Este trabajo asume como punto de partida la indeterminación relativa de los Derechos actuales. Desde el punto de vista de la actividad judicial esta circunstancia determina una mayor libertad de los jueces que se traduce en la existencia de diferentes posibilidades interpretativas. Por esta razón el papel de la argumentación en la actividad judicial se ha visto reforzado pero, al mismo tiempo, se plantea el problema de cómo controlar a los jueces y qué tipo de responsabilidad tienen en el ejercicio de sus funciones.

This paper takes as starting point the relative indeterminateness of current legal systems. This circumstance determines from the point of view of judicial activity a substantial freedom for judges, which translates into the existence of different interpretive possibilities. For this reason the role of argumentation in judicial activity has been reinforced, but at the same time the question arises of how to control the judges and what kind of responsibility they have in exercising their functions.
