Resumen de ¿Debiéramos preocuparnos de la condena de inocentes en Chile?: antecedentes comparados y locales para el debate

El propósito del artículo es entregar información y reflexiones que puedan servir como punto de partida para alimentar un debate más intenso en nuestra comunidad jurídica sobre el tema de los errores del sistema de justicia penal (condena de inocentes), sus causas y, especialmente, identificar algunas prácticas instaladas en distintos actores del sistema que podrían influir en su producción en nuestro país. Para ello, el artículo revisará el estado del debate en la materia en el ámbito comparado (especialmente en el mundo anglosajón y particularmente en los Estados Unidos) y luego aportará evidencia de que se trata de un tema que debiera generar mayor preocupación en Chile

The paper's objective is to deliver information and analysis that could be useful as a starting point to feed a debate in the Chilean legal community about the issue of wrongful convictions (miscarriages of justice), its causes, and specially, in the identification of practices developed by the different actors of our criminal justice system that could influence cases of miscarriages of justice in Chile. To achieve this goal the paper will review the current debate at comparative level (with focus in the Anglo-Saxon world and particularly in the Unites States) and then will present evidence that shows in Chile we should be more concern about this issue in the nearfuture
