Reconocimiento y ejecución de sentencias mexicanas de divorcio en Venezuela

    La sentencia la dicta el juez com- petente para proceder a su ejecución, y mate- rializar así la justicia que aspira todo proceso judicial. Pero en la fase de ejecución se pueden presentar varias circunstancias, no sólo si se tra- ta de ejecución forzosa, en defecto de ejecución voluntaria, sino también cuando dicho juez se encuentra imposibilitado por razones territoria- les para proceder a su ejecución, ya sea porque el objeto del litigio está en otro e stado o los efec- tos desean hacerse valer más allá de las fronteras del e stado en el cual se dictó.

    e l cruce de fronte- ras geográficas no debería alterar las situaciones jurídicas válidamente constituidas en un e stado determinado; para ello es importante establecer mecanismos que permitan el reconocimiento y eficacia extraterritorial de las decisiones juris- diccionales de un e stado en otro. A partir de dos casos conocidos por el t ribunal s upremo de Justicia venezolano se analiza la problemá- tica en torno al reconocimiento y ejecución de sentencias mexicanas de divorcio en Vene- zuela, según la c onvención Interamericana sobre el tema y la normativa interna aplicable

    Judges rule their decisions to enforce fo- reign divorce judgments and therefore to achieve pro- cedural justice.

    n otwithstanding of that, the enfor- cement could face different challenges, not only about its coercive enforcement � lacking of voluntarily compliance of the original decision � but also ju- risdictional/territorial limitations.

    t hese limitations are related with the existence of different locations among the place of the original subject matter, the place of its effects and, the place where the enforce- ment decision will be ruled. However, geographical boundaries should not affect vested rights.

    t herefore, it is crucial to grant mechanisms that will ensure the enforcement of foreign decisions. Based on two Venezuelan s upreme Court decisions, this document analyses issues related with the enforcement in Ve- nezuela of Mexican divorce judgments, considering both the i nter- a merican Convention on Extraterri- torial Validity of f oreign Judgments and a rbitral a wards and Venezuelan domestic rules
