"Dura lex sed lex": interpretación a la luz del "ius certum" en el derecho

    En la presente investigación abordaremos al ius certum como circunstancia misma de sujeción del juzgador romano al precepto normativo, destacando las diferencias en cuanto a la interpretación y finalidad del ius, al resolver el conflicto. En contraposición con el del derecho moderno y la noción del principio de legalidad jurídica como base del ius positivismo.

    En este ejercicio se evidenciará que la frase dura lex sed lex, enarbolada por los iuspositivistas como fundamento de la exégesis misma, es producto de una equívoca interpretación de lo expresado por Ulpiano en el Digesto.

    Concluyendo que el principio de certeza jurídica ius certum, ha sido parte del modelo romanista en armonía y coherencia con el ius, contrario al principio de legalidad que otorga preeminencia al contenido gramatical de la norma, aun en contravención de la justicia y equidad.

    In the present investigation we will approach to ius certum like same circumstance of subjection of the Roman juzgador to the normative rule, emphasizing the differences as far as the interpretation and purpose of ius, when solving the conflict. In contrast with the one of the modern right and the notion of the principle of legal legality as it bases of ius positivismo.

    In this exercise it will be demonstrated that the phrase lasts lex thirst lex, hoisted by the iuspositivistas like foundation of the same exégesis, is product of an ambiguous interpretation of the expressed thing by Ulpiano in the Digesto.

    Concluding that the principle of legal certainty ius certum, has been part of the romanista model in harmony and coherence with ius, in opposition to the legality principle that preeminence to the grammar content of the norm grants, even in disobedience of justice and fairness.
