    El 14 de diciembre de 2011 se publicó en el Diario Oficial de la Federación (DOF) una adición al Artículo 100 de la Ley General de Salud (LGS). La Fracción VII adicionada establece lo siguiente: «Es responsabilidad de la institución de atención a la salud proporcionar atención médica al sujeto que sufra algún daño, si estuviere relacionado directamente con la investigación, sin perjuicio de la indemnización que legalmente corresponda», estableciendo de manera puntual la responsabilidad institucional cuando se autorice realizar investigaciones en ella, situación relevante en los derechos fundamentales. Se presenta el espíritu del legislador ordinario desde la iniciativa de ley hasta su promulgación.

    On December 14, 2011 an addition to Article 100 of the General Health Law was published in the Federation Official Journal. The added section VII states that: ¿It is the responsibility of the Health Care Institution to provide medical care to the subject that is injured, if this is directly related to the investigation, without prejudice to the legally appropriate compensation´, thus establishing the institution¿s liability in an precise way when it authorizes research. This is a relevant situation of Fundamental Rights. We will present the spirit of the ordinary legislator from the Law initiative to its enactment.
