Este artículo realiza una defensa de un cambio en el modelo de instrucción penal en España y propone que se vea sustituida por la investigación oficial de los delitos, realizada por el MF bajo el control de un juez de garantías. Las misiones que la CE atribuye a los Jueces y al Ministerio Fiscal están intercambiadas en una instrucción de tintes inquisitoriales. El Juez debe dejar de realizar actos no jurisdiccionales que valora el mismo desde su posición personalísima. El Ministerio Fiscal debe poder realizar su misión activa �y no reactiva como la del juez� de defensa de la legalidad y el interés público también desde la fase de investigación, pues a él le corresponde sostener después la acusación. Frente a modelos más ejecutivos o judiciales, «la imparcialidad colectivamente reflexionada» del Ministerio Fiscal español dotaría al procedimiento de la mejor garantía.

This paper suggests a change in the Spanish penal procedure regarding its actual inquisitorial nature. At present time, as the Judge is in charge of criminal investigation and the Public Ministry controls the Judge, they have exchanged their constitutional missions within the pre-trial phase. The Judge must stop deciding on coercive investigation activities at his own and sole proposal. The Public Ministry must be capable to accomplish its proactive constitutional mission �not reactive as the Judge�s- defending legality and public interest since the initial phase; as the faculty to hold charges during the trial belongs to the Public Ministry. Compared to more executive or judiciary public ministry models, the Spanish Public Ministry «impartiality collectively reflected» would unsurpassed endure all the due processes principles within the pre-trial phase.
