El Estado Moderno surge bajo el modelo del absolutismo político y la consiguiente negación de las libertades ciudadanas. El Estado absorbe entre sus competencias a la religión, dando lugar con la reforma protestante a las Iglesias de Estado. En ciertos sectores doctrinales se mantiene, sin embargo, la defensa de la libertad y, en concreto, la libertad religiosa, que acabará siendo formalizada en la Constitución de los Estados Unidos de América. La democracia y las libertades ciudadanas serán, a partir de ese momento, la referencia para los demás Estados. ¿Este nuevo modelo de Estado y la libertad religiosa, junto con la separación Iglesia y Estado, tienen carácter universal?

The modern State arose from political absolutism and its ensuing infringements of fundamental rights. The State encompassed religion amongst its authorities, so that protestant reform resulted in a system of State Churches. However, some legal doctrines did continue to defend freedom of religion from undue interference, and all this brought about explicit protection of religion in the United States constitution. Thereafter democracy and freedom were bound to be a frame of reference for other States. The paper focuses on whether or not the new pattern of State and freedom of religion, deriving from the current separation between State and religion, constitutes a universal character.
