The territorial social dialogue: challenges and prospects for the trade unions

    Forms of territorial social dialogue are developing at the regional or local level in most European countries. This article looks at the challenges facing the trade unions, particularly in France, as a result of this development. The first part examines the reasons for it - decentralisation of the state, changes in local government as well as in production systems - and the reasons why the trade unions are becoming increasingly involved. A second section focuses on a number of different instances of territorial social dialogue that reveal the diversity both of aims and of subjects treated, the wide-ranging public and private players involved and the highly diverse outcomes. The third part asks how these forms of social dialogue affect the unions. Do they represent a means whereby trade unions can extend their influence and strengthen their traditional areas of activity or do they contribute to weakening collective bargaining insofar as they offer less formalised methods of negotiating social outcomes that may detract from the role of the social partners to the benefit of government actors? The view put forward in this article is that the trade unions may well, under certain conditions, stand to gain from involvement in the territorial social dialogue.

    Dans la plupart des pays européens se développent des formes de dialogue social territorial au niveau régional ou local. Cet article analyse leurs enjeux pour le syndicalisme, particulièrement en France. La première partie examine les raisons de ce développement - décentralisation de l'Etat, transformations de l'action publique et changements dans les modes de production - et les raisons pour lesquelles les syndicats s'y investissent de manière croissante. Dans une deuxième partie sont retracées plusieurs expériences de dialogue social territorial qui font ressortir la diversité des objectifs et des sujets traités, la pluralité des acteurs impliqués (publics et privés), la variété des produits du dialogue. La troisième partie s'interroge sur les conséquences de ce dialogue social pour le mouvement syndical. Est-ce un moyen d'élargir son influence en renforçant son champ d'action traditionnel ou bien contribue-t-il à affaiblir la négociation collective en proposant des méthodes non contraignantes de négotiation sociale et en réduisant le rôle des partenaires sociaux au profit de celui de l'acteur public? Le point de vue défendu dans cet article est que le dialogue social territorial pourrait permettre un renouveau du syndicalisme sous certaines conditions.

    In den meisten europäischen Ländern entwickeln sich Formen des territorialen sozialen Dialogs auf regionaler oder lokaler Ebene. Die Autorin befasst sich mit den Herausforderungen, die sich aus dieser Entwicklung für die Gewerkschaften insbesondere in Frankreich ergeben. Im ersten Teil untersucht sie die Gründe dafür - Dezentralisierung des Staates, Veränderungen im Bereich der öffentlichen Aufgaben und der Produktionssysteme - und die Frage, warum die Gewerkschaften sich zunehmend beteiligen. Der zweite Teil berichtet über mehrere Erfahrungen des territorialen sozialen Dialogs und zeigt die Vielfalt der Ziele und der behandelten Themen, aber auch das breite Spektrum der beteiligten öffentlichen und privaten Akteure sowie die höchst unterschiedlichen Ergebnisse. Im dritten Teil wird die Frage gestellt, wie sich diese Formen des sozialen Dialogs auf die Gewerkschaften auswirken. Stellen sie für die Gewerkschaften ein Mittel dar, um ihren Einfluss auszuweiten und ihre traditionellen Tätigkeitsbereiche zu stärken, oder tragen sie im Gegenteil zur Schwächung der Tarifverhandlungen bei, da sie weniger verbindliche soziale Verhandlungen vorschlagen, die die Rolle der Sozialpartner reduzieren und damit gleichzeitig die Rolle der öffentlichen Akteure stärken? Die Autorin vertritt die Ansicht, dass der soziale Dialog auf territorialer Ebene - unter gewissen Bedingungen - zu einer Erneuerung der Gewerkschaftsbewegung beitragen könnte.
