    The new Moroccan Constitution acknowledges the existence of a real judicial power and establishes a new body to guarantee its independence, the Superior Council of the Judiciary, vested with wide powers regarding the monitoring of magistrates and judiciary policy. This reform, together with a transformation of the framework of constitutional litigation, provides Morocco with an innovative and effective constitutional instrument. However, this reform is dependent on the organic laws required for its implementation.

    La nouvelle Constitution marocaine reconnaît l’existence d’un véritable pouvoir judiciaire et met en place un organe, le Conseil supérieur du pouvoir judiciaire, garant de son indépendance et doté de larges compétences s’agissant de la gestion des magistrats et de la politique judiciaire. Cette réforme, qui s’accompagne d’une transformation du contentieux constitutionnel, alloue au Maroc un outil constitutionnel novateur et performant. Cependant cette réforme est tributaire des lois organiques nécessaires à son accomplissement.
