Resumen de Objeciones a la jurisdicción arbitral del CIADI

En el arbitraje de inversión constituido bajo las Reglas del CIADI, a cada tribunal le corresponde decidir sobre su propia jurisdicción y competencia respecto de las controversias que le han sido planteadas. Para ello deberá analizar los instrumentos normativos que resulten aplicables, tanto internacionales como nacionales. En estas controversias es muy común que los Estados demandados presenten objeciones a la jurisdicción del tribunal CIADI. En el presente estudio se plantean algunos problemas tomados de la práctica arbitral y sus posibles respuestas en torno a la determinación de la jurisdicción subjetiva, objetiva y por razón del tiempo.

In investment arbitration constituted under the Rules of the ICSID, to each tribunal is to decide its own jurisdiction and competence over the controversies that has been raised. For this, it should analyze the policy instruments that are applicable both internationally and nationally. In these controversies is often seen that the respondent States object the ICSID tribunal�s jurisdiction. Therefore, emerge some problems taken from the arbitral practice and their possible answers on the subjective, objective and according to time determination of jurisdiction.
