The Author analyses the recent decisions of the Italian Constitutional Court concerning the relationship between State and Regions in the field of adoption of technical regulations.
This jurisprudence seems to confirm the dismissal of the principle of the technical government, which influenced the relationship between State and Regions before the constitutional revision established by Constitutional law n. 3/2001.
The essay points out the problems and risks that may arise from the new judicial interpretation, and explicitly proposes a reaffirmation of the principle of technical coordination.
