Resumen de Axa v. Lord Advocate: "Putting the Axa to Parliamentary Sovereignity"

  • This paper considers the UK Supreme Court decision inAxa v. Lord Advocate. Although it might appear a purely Scottish case, dealing with damages produced by asbestos and the possibility of recovering them by virtue of an Act of the Scottish Parliament, it is argued that this case clarifies the status of Acts of the Scottish Parliament and the nature of his powers. Furthermore, relevant considerations of the UK constitutional principles of parliamentary sovereignty and the rule of law are addressed.
